Terms & Conditions

This Contest Terms & Conditions (hereinafter referred to as the “Terms & Conditions”) are applicable to all the participants of the Contest (hereinafter referred to as the “Contest”) promoted/organized by Taxsmile.com India Pvt. Ltd (hereinafter referred to as “TIPL”). TIPL in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/contestant/winner agrees to abide by such additions, alterations, modifications and changes. If you do not agree to the terms mentioned herein you are not eligible to participate in the Contest.

1. The Contest is open during the period May 1, 2008 to July 27, 2008.
   
   
2. Users who file their Income Tax Return for Financial Year 2007-08 (Assessment Year 2008-09) with Taxsmile by July 27, 2008 would be eligible to participate in this contest.
   
   
3. Eligible users will be required to answer simple questions in a Quiz Format and submit their entry to participate.
   
   
4. Prize for this contest is the entire amount of Tax paid for the Financial Year 2007-08 as disclosed in the tax return filed with Taxsmile. The Prize money will be restricted to a maximum of Rs. 2,00,000.
   
   
5. One winner will be selected on the basis of the best answer in the complete the statement section, from complete and correct entries submitted.
   
   
6. Decision of TIPL with respect to selection of winners shall be final and binding upon the participants/winner.
   
   
7. No winner shall be allowed to participate again in the same contest whether by the same e-mail id or otherwise.
   
   
8. Winner agrees to his/her name being published in the newsletters and the website.
   
   
9. The prize money will be awarded subsequently subject to verification and fulfillment of all Terms and Conditions set under this Contest
   
   
10. This offer of participation is open to Residents of India only (This is not applicable to the States/ Union Territories where there is statutory ban on online contests). Participation in the Contest is purely voluntary. No entry fee is payable for participation in the Contest.
    
    
11. Employees of TIPL and Employees of its holding Company, affiliates Companies/subsidiary Companies, sponsors, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in this contest.
    
    
12. At the time of participation the participant/contestant must be at least 18 years of age. Production of Government accredited date of birth proof to the satisfaction of TIPL is mandatory to claim the prize.
    
    
13. The participant shall provide information to TIPL for the contest. Information provided must be sufficient to identifying the participant of the Contest. Moreover, the information so provided shall be deemed to have been voluntarily supplied, non-confidential and the participant hereby discharges all obligations of confidentiality. TIPL shall be free to reproduce, use, disclose and distribute the information to third parties without limitation.
    
    
14. TIPL will not be responsible for loss, quality and performance of the prizes. For any defects, queries, complaints, claims, etc., the winners are required to contact the concerned manufacturers directly and without involving TIPL in any manner whatsoever and without any liability to TIPL.
    
    
15. TIPL shall not be responsible in any way for failure/delays of any backend technology and the resultant inability of a reader to send in his entry or register/participate in the contest. Only those entries which are received by TIPL shall be considered for the contest and TIPL shall not be responsible for non-receipt, delay of any entry. TIPL does not take any responsibility for any errors arising out of incorrect or incomplete entries. Moreover, TIPL does not accept any liability for incorrect or incomplete entries. Proof of dispatch shall not be accepted as a proof of delivery.
    
    
16. TIPL shall not be responsible for alteration or unauthorized access to entries, or entries lost whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes beyond its control.
    
    
17. TIPL shall not be liable for system/server failures. Neither can TIPL be held responsible for the failure to fulfill the obligations of any of the third parties involved in the contest.
    
    
18. The contents of specific postings/uploads which are posted/uploaded are the responsibility of the participant who makes such postings. Though TIPL reserves the right to filter out postings which may carry offensive, harmful, inaccurate, pornographic content or content which infringes on the Intellectual Property Rights of any third party or any rights of publicity or privacy or is defamatory, libelous, threatening or harassing or is indecent and contains any viruses, Trojan horses, trap doors, back doors, Easter eggs, worms, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information or otherwise inappropriate content, it does not take any responsibility for such postings/content and/or for deceptive, mislabeled or defamatory content. The participants are expected to use common sense and proper judgment while using the services herein.
    
    
19. The views/ideas/contents expressed/posted are of the respective participants and TIPL does not support/endorse any such views, ideas, contents and expressions. Moreover, TIPL does not represent or guarantee the truthfulness, accuracy, or reliability of any such postings/content posted and the participants are cautioned to use common sense and proper judgment in this regard. Any reliance on the content posted by a participant shall be entirely at the risk of the participant.
    
    
20. TIPL reserves the right without prior notice to access, read preserve and/or disclose the personal information of the participant including the content of the postings if the same is required for the limited purpose of contest. OR as below:
    
    
1. in order to comply with any court judgment/decree/order/directive,
2. by any legal/government authority;
3. by applicable law;
4. By professional/legal advisers, directors, employees/agents/representatives of TIPL in connection with these terms & Conditions or otherwise;
5. For investigating potential violations of the terms herein or applicable national & international laws;
6. for investigating deliberate damage to the Services or its legitimate operation;
7. for detecting, preventing, or otherwise addressing security and/or technical issues,
8. for responding to service support requests, or
9. For protecting the rights, property or safety of TIPL and/or its Directors, employees and the general public at large.
10. for any other purpose as may be deemed fit by TIPL.
    
    
21. TIPL reserves the right to store and process the personal information provided by the participant/winner in India or any other country where TIPL or its agents/representatives/group companies maintain storage and processing facilities and the participant by using the services herein consents to any such transfer of information outside India without prior notice.
    
    
22. TIPL shall not be liable or responsible for deletion and/or failure to transmit or store any postings/blogs posted by a participant or personal information provided by the participant or any other communication maintained for the contest. Further, TIPL reserves the right to create limits on storage at its sole discretion without assigning any reason whatsoever and without giving any prior notice.
    
    
23. TIPL at all times reserves the right to refuse to accept, post, display or transmit any Content in its absolute sole discretion.
    
    
24. TIPL reserves the right to change the timing/dates/hours of the Contest without any prior intimation to the participants.
    
    
25. TIPL IS NOT RESPONSIBLE FOR LOST, LATE, INCOMPLETE, ILLEGIBLE OR MISDIRECTED E-MAIL, FOR FAILED, PARTIAL OR GARBLED COMPUTER TRANSMISSIONS, OR FOR TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, ELECTRONIC MALFUNCTION OF ANY FACSIMILE EQUIPMENT, NETWORK, HARDWARE OR SOFTWARE. THE REGISTRATION FORMS BECOME THE PROPERTY OF TIPL AND NONE WILL BE RETURNED.
    
    
26. Information on how to enter the contest forms part of these Terms & Conditions. Entry into the contest will be deemed acceptance of these Terms & Conditions.
    
    
27. TIPL will in no way be responsible for circumstances beyond its control, which hinder the completion of the Contest.
    
    
28. Contest winners are fully responsible for the taxes and levies on winnings as may be imposed by Central, State and Local government authorities from time to time.
    
    
29. The winners shall be required to produce the following documents to the satisfaction of TIPL in order to claim the prize Below documents shall be evidenced by authentic Government documents such as passport, PAN Card, Driving License etc.:
    
    
1. Photo identity proof;
2. Date of Birth Proof;
3. Address Proof;
   
   
30. Originals of the documents furnished above, should be made available to TIPL for verification at any time before the prize is given, if so insisted upon by TIPL.
    
    
31. Only the winners shall be informed by TIPL in such manner as may be decided by TIPL from time to time. If informed via email, return of any email notification as undeliverable or failure by the winner/participant to reply as specified in the email within the time stated therein shall result in disqualification and selection of an alternate winner.
    
    
32. The Participants, who have participated in the contest and have been declared as winners, may voluntarily opt out of it.
    
    
33. The mode of delivery of the prizes, shall be conveyed to the winners, separately.
    
    
34. Participants shall provide their PAN no as the Winner(s) shall be liable to bear an amount equivalent to Tax Deducted at Source (TDS) as may be applicable from time to time. The prize is subject to Income Tax as per I.T. Act and any other applicable taxes as per prevailing income tax law.
    
    
35. In case false/fake registration details are submitted, the concerned participant/winner shall be disqualified.
    
    
36. Though TIPL shall make every effort to declare the results of the contest on the due date/hour, it shall not be responsible for any delay in announcing the winner(s) due to any reasons beyond its control.
    
    
37. Prizes shall not be substituted. The Prize shall not be transferable and no such requests shall be entertained by TIPL at any point.
    
    
38. The winner shall claim the Prize within 60 days of so notified by the Company and is solely responsible for all expenses/taxes related to the acceptance and use of the offer. Any claims received after this period, shall not be entertained and TIPL shall use its discretion in this regard.
    
    
39. In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize or if TIPL is unable to reach/contact the winner, TIPL shall have the absolute discretion to deal with such prize as it deems fit and/or select an alternative winner.
    
    
40. No correspondence will be entertained with regard to this contest.
    
    
41. Participants/winners may be required by TIPL to participate in a photo, video and/or film session and acknowledge that TIPL may use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit for the limited purpose of contest or as mentioned herein above.
    
    
42. TIPL in its absolute discretion may publicize, upload, broadcast or otherwise disclose a participant’s/winner’s name, particulars, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, or generally. TIPL may promote or advertise that a winner has won the contest.
    
    
43. TIPL shall not be responsible for any loss or damage suffered by the winner while participating in the Contest.
    
    
44. The participant agrees to indemnify TIPL and its directors, employees and agents against any third party claim, action, suit or proceeding resulting from his participation in the contest or arising out of the Content submitted, posted, transmitted or otherwise made available by the participant through the contest, or use of the Service herein by the participant or violation of these terms and conditions or violation of any third party rights by the participant/winner.
    
    
45. This offer cannot be clubbed with any other offer.
    
    
46. TIPL in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes.
    
    
47. TIPL reserves the right to extend or to cancel, or change the manner in which the contest is organized or discontinue or terminate the contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.
    
    
48. Failure by TIPL to enforce any of these Terms & Conditions in any instance(s) shall not give rise to any claim by any person.
    
    
49. Any attempt by a participant to deliberately damage or undermine the legitimate operation of the activity is a violation of Criminal and Civil Laws and should such an attempt be made, TIPL reserves the right to seek damages from any such Candidate to the fullest extent permitted by law.
    
    
50. The Contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Contest and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by TIPL. The venue of arbitration shall be Mumbai and the proceedings of such arbitration shall be in English Language only.
    
    
51. All Participants and winners waive any and all rights of claim against TIPL, with regard to this Contest.
    
    
52. All disputes shall be subject to the exclusive jurisdiction of Mumbai Courts only.
    
    
53. All trademarks and copyrights are property of their respective owners.
    
    
54. Participation in the contest implies acceptance of all the terms & conditions herein.
    
    
55. By subscribing to or using any of services/contest, Participants agree that they have read, understood and are bound by the terms and conditions set out herein.
